Negotiations with Canada Post

Your bargaining team unanimously rejected the last offer of Canada Post of November 16


Here's why:

While there were minor increases in the wages, and Canada Post was prepared to renew the job security clause, there were absolutely no changes of substance to the Short Term Disability (STD) scheme.

Here is a brief summary of what was proposed:

The Plan

  1. Seven days non cumulative “personal leave”
  2. Seven calendar day waiting period
  3. Current sick leave entitlements are frozen effective January 1, 2010.
  4. Sick leave can only be used to top up sick leave – nothing else
  5. If you have exhausted your 7 personal days, and you need to be off for a family related reason, that will be leave without pay
  6. An indeterminate employee must be on strength the last day of the fiscal year to be paid out for any unused “personal” days.

Eligibility

  • Terms will not be eligible for Short term Disability benefits
  • Strict eligibility requirements for STD benefits determined by Manulife
  • The “Disability Management Provider” (Manulife) has the final say on eligibility for benefits.
  • The “Disability Management Provider”  also has the final say on whether or not the treatment prescribed by your physician is deemed appropriate.
  • You will be responsible for providing all medical information to the “Disability Management Provider”

Benefits

  • First 15 weeks, if approved,  are paid through Manulife at 70% salary if you have no “banked” sick leave
  • Second 15 weeks if approved, are paid through EI benefits ($435 per week) plus top up to 70% of your salary if you have no banked sick leave 
  • Only If you have “banked” sick leave you can use it to top up your Manulife or your EI
  • You must comply with, and participate in any rehabilitation program recommended by the Disability Management Provider – if you don't your benefits will be cut off.
  • You will not be able to use any of your banked sick leave to transition from Short Term Disability to Long Term Disability

Appeals

  • There are three levels of appeal – it is not grievable
  • Level 1 – you must submit a written request to appeal within 7 calendar days. You must also provide any additional medical information within 30 calendar days. A Manulife claims manager will provide a decision
  • Level 2 – if you disagree you have 7 days to submit in writing to the supervisor of the Manulife case manager
  • Level 3 – You have 7 days to appeal, The Case Manager will review with the General Manager of Total Compensation who will review on the basis of the process and whether all the steps were followed. This will not be a review of any new medical information.
  • The decision shall be final and binding
