Appeal hearings conclude and the wait for the decision begins

The Federal Court – Trial Division has concluded its eight days of hearings in which it heard arguments from the PSAC, the Canadian Human Rights Commission and the Canada Post Corporation regarding Canada Post's application to have the 2005 Tribunal pay equity decision set aside. The Court also heard the PSAC's application to set aside that portion of the Tribunal's award which cut the amount of money owed by fifty percent.

The court reserved judgement on both applications and will issue its decision in due course. It is impossible to accurately predict when the decision will be released. We anticipate, given the length of the hearings and the magnitude of the documentation the Court must review, that this will not occur for some time. The Trial Division Court's decision then may be appealed to the Federal Court of Appeal by either party.
