PSAC Pay Equity Bulletin
No decision yet in taxation of interest payments case
PSAC’s challenge of the government’s practice of taxing
the interest payments received by many of our current and former
members as part of the pay equity complaint settlement was heard
in the the Tax Court on January 18 and 19, 2005.
The judge hearing the case indicated that it might be some time
before a decision was issued. Information will be posted on the
union’s web site when the decision is issued.
No word yet from the Human Rights Commission on arrears interest
case
The union is still waiting to hear from the Canadian Human Rights
Commission on our complaint that the high rate of arrears interest
charged by the Canada Revenue Agency when pay equity adjustments
were carried back to the year in which the money should have been
received is discriminatory. The CHRC had initially dismissed the
complaint with no explanation or analysis to support their dismissal.
In December 2004, the Federal Court (Trial Division) allowed the
PSAC’s judicial review and referred the complaint back to
the Commission.
